Terms of use
1. Who we are
This site is operated by ApexCommerce Pty Ltd (ABN 48 622 118 907), Level 5, 120 Spencer Street, Melbourne VIC 3000, Australia. "We", "us" and "our" mean that company; "you" means anyone using this site. Phone 1300 000 000 · help@apexcommerce.com.au.
2. Using this site
We grant you a personal, non-exclusive licence to browse and buy. Don't scrape our catalogue, interfere with checkout, resell access, or use the site for anything unlawful. Stock counts, prices and delivery estimates are shown in good faith and updated continuously — see sections 4 and 7 for what happens when reality disagrees with the screen.
3. Your account
You can buy as a guest — an account is never required to place an order. If you do create one, keep your password to yourself and tell us promptly if you think someone else has it. One account per person; we may close duplicate or fraudulent accounts (section 11). You must be 18 or have a guardian's permission to buy age-restricted items where applicable.
4. Products & pricing
All prices are in Australian dollars and include GST — the GST component is shown on your invoice and in every confirmation email. Product photos are ours or our suppliers'; colours can shift slightly between screens. If a price is an obvious error (a $2,499 laptop listed at $24.99), we'll cancel and refund in full rather than charge you — and we'll say plainly that it was our mistake.
5. Orders & the contract
Your order is an offer to buy. The contract forms when we dispatch the item, not when you click pay — that's why you can still cancel free of charge up to the moment your parcel is picked, and why a pre-authorisation on your card isn't a completed sale. We may decline an order (stock ran out between click and pick, payment failed fraud checks) and you'll be refunded in full with the reason stated — never a silent cancellation.
6. Payment
Cards are processed by Stripe; we never see or store your full card number. Buy-now-pay-later (Afterpay and similar) is a separate agreement between you and that provider — their terms apply to the instalments, ours to the sale. If a payment fails mid-checkout, any hold on your card expires on its own; you will not be charged twice for one order.
7. Delivery
Delivery windows shown at checkout are generated from our shipping-zone table and current carrier performance — they're estimates we hold ourselves to, not guarantees against weather, strikes or broken vans. When a promise slips on our side (like a missed courier pickup), we tell you before you have to ask, with a new dated window. Risk in the goods passes to you on delivery; safe-drop instructions you authorise are followed exactly as written.
8. Returns & your guarantees
On top of the law: 30-day change-of-mind returns on most items, free via any AusPost parcel locker, refunds to your original payment method within 3–5 business days of the return scan. Faulty-item returns never count against you, never need the original packaging, and a refund is never made conditional on answering a survey. Exclusions (final-sale, hygiene-sealed items once opened) are labelled on the product page before you buy, not revealed after.
9. Reviews & your content
You keep ownership of what you write; you give us a licence to display it with your first name and order-verified badge. We publish negative reviews — moderation removes spam, abuse and fake content in both directions. We don't pay for positive reviews or gate reviews behind a purchase of any minimum value.
10. Gift cards & rewards
Gift cards are valid for at least 3 years from purchase, carry no expiry-creep fees, and GST applies on redemption rather than purchase (that's why the card total you pay shows no GST line). Rewards dollars are a goodwill program: they can lapse with 60 days' notice by email, are deducted back if the order that earned them is refunded, and are always shown as a separate line so you can see what's cash and what's credit.
11. Suspension & ending accounts
We may suspend an account for fraud indicators, abusive conduct toward staff, or repeated chargebacks — always with a reason and a way to appeal to a human. You can close your account at any time from account settings; closure doesn't erase records we're legally required to keep (tax law means order records stay 7 years — see the privacy policy).
12. Our liability
To the extent the law allows, our liability for losses not covered by the ACL is limited to the value of your order. Nothing in these terms limits liability for death, personal injury, or fraud, and nothing overrides your consumer guarantees — if a clause ever reads that way, that clause fails and the rest stands.
13. Privacy
How we collect, use and share your data is set out in our privacy policy — written to be read, with a collection notice at the top.
14. Governing law
These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction — which never diminishes mandatory protections in your own state or territory.
15. Changes to these terms
We'll email account holders at least 14 days before any material change and keep dated versions on this page. "Material" means changes to price policy, returns, or liability — not typo fixes. If you don't agree with a change, you can close your account before it takes effect and keep every right you've already earned.
